Terms of Service for PlugZap.com

1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and DTLA Professional Services, LLC, doing business as PlugZap (“we,” “us,” or “our”), concerning your access to and use of the PlugZap.com website, as well as any other media form, community board, or free tools related, linked, or otherwise connected thereto (collectively, the “Site”).
By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and must discontinue use immediately.
2. Use of Free Tools and Scripts
PlugZap provides curated, free website widgets, scripts, and online tools designed to work across various platforms (such as WordPress, HTML sites, and site builders).
- License: We grant you a revocable, non-exclusive, non-transferable, limited right to download, install, and use our tools strictly for your personal or business website.
- No Warranty: All tools and scripts are provided on an “AS-IS” and “AS-AVAILABLE” basis. While we strive for excellence, we make no representations or warranties that the tools will be compatible with every theme, plugin, or third-party platform. You assume the risk of any conflicts or issues arising from installing third-party code on your website.
3. Community Message Board Conduct
We provide a community message board for users to seek support, share ideas, and interact with others. By participating, you agree to abide by the following rules:
- You will not post any malicious code, viruses, or spam.
- You will not post unlawful, harassing, defamatory, or abusive content.
- We reserve the right, but not the obligation, to monitor the community board and, at our sole discretion, remove any content or ban any user for violating these terms, without notice.
4. Donations and Payments
PlugZap offers its tools for free but accepts voluntary donations to help maintain and develop the platform.
- Voluntary Nature: Donations are strictly voluntary and are not required to access or download any of our tools.
- Payment Processors: Donations are processed securely through third-party platforms such as Stripe and PayPal. By making a donation, you agree to the terms and conditions of those respective payment processors.
- Refunds: Because donations are voluntary gifts to support our project, they are generally non-refundable.
5. Intellectual Property Rights
Unless otherwise indicated (such as open-source code hosted on GitHub), the Site is our proprietary property, and all source code, databases, functionality, software, website designs, text, and graphics on the Site are owned or controlled by us, and are protected by copyright and trademark laws.
6. Third-Party Websites and Content
The Site may contain links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties. We are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site.
7. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or website downtime arising from your use of the Site or our downloadable tools, even if we have been advised of the possibility of such damages.
8. Governing Law
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.
9. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time and for any reason, at our sole discretion, without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or our tools.
